What is an Authentication & Legalization?
The first step is always a notarization - this takes the form of either a certified true copy, or the witnessing of your signature. Once your document has been notarized by Brosgall Legal, our signature and notarial seal must then be authenticated for the document to be accepted by the foreign consulate or embassy in Canada. There are various methods to obtain this authentication, and every country has their own standard. After this second step, the third step is consular legalization. This is when the authenticated document is presented to the consulate of the foreign jurisdiction in Canada to confirm that the correct procedure was followed in British Columbia or Ottawa. Once completed, the document becomes legal and valid for use overseas.
What is an Apostille?
It is the internationally accepted way of providing a guarantee regarding the authenticity of a document. Under the Hague Apostille Convention, an Apostille is a prescribed certificate attached to your document. Between two countries who have signed the Hague Apostille Convention, an Apostille certification immediately validates your document for use in the destination country. But as Canada has never signed this Convention, we must rely on the more complicated chain authentication method.
The Difference between Apostille vs. Authentication & Legalization
Historically (pre-1961), all documents notarized by lawyers or notaries around the world for use in other countries had to go through the authentication and legalization process. Then in 1961, many countries signed the The Hague Convention Abolishing the Requirement of Legalization for Foreign Public Documents. This enabled two signatory countries to take advantage of a shortcut, which they called an 'Apostille'. Canada has never signed this Convention, so Canadian lawyers and notaries cannot provide Apostille certificates. Instead, we still utilize the original, pre-1961 chain method for processing international transactions. In other words, we use the authentication and legalization method, which is the equivalent to an 'Apostille' in the countries who signed the 1961 Convention.
