APOSTILLE CONVENTION OF 1963

On January 11, 2024, after 61 years, Canada finally became a member of the Apostille Convention, formally known as The Convention of 5 October 1961 Abolishing the Requirement of Legalisation for Foreign Public Documents. As Canada has now ratified the Apostille Convention, there are many new rules and requirements for authenticating personal and corporate documents. This applies to Property Deeds, Notarizations, Vital Statistics Certificates, Intellectual Property documents, Criminal Record Checks, and other public and private legal documents being sent abroad.

Before January 11, 2024, submitting documents for provincial authentication and consular legalization had been the standard diplomatic method of recognizing international documents for hundreds of years.  After January 11, 2024, Canadians who are sending documents overseas must authenticate their official documents by way of a certificate called an Apostille. This new method has different procedures, with many new rules and regulations.

Apostilles are issued by the proper provincial authority or by Global Affairs Canada, depending on the type of document, and where in Canada the document was issued and/or notarized. Once we Apostille a document, it becomes legal and valid for use in any of the other Apostille Convention's 125+ member countries, including the USA, Brazil, Colombia, Greece, Israel, Mexico, Panama, Poland, Russian Federation, Saudi Arabia, South Africa, Ukraine, and the United Kingdom.
