What is a Will?
A Will is a written document that states what happens to your assets, valuables, and other property after you die.
Why is it Important to have a Will?
Everyone should create a Will so that:
- Your property is distributed as you wish after you die.
- You can take care of your family and loved ones.
- Your Executor can easily make funeral arrangements and handle your estate.
- To name a guardian if you have minor children.
What are the Requirements for a BC Will?
In BC, you need to be 19 years old to make a Will, and be capable of managing your affairs. The Will should be made without intimidation by others. Your Will should be dated, and it should name your executor(s) and beneficiarie(s) - basically, who gets what! The terms of the Will can be quite general, however, you may want to choose to give specific things to certain beneficiaries, such as cars, art work, etc. The Will must be signed before two witnesses, while you are all together. Each page should be initialed by the witnesses and yourself. The Witnesses must be an adult and may not be beneficiary, or a spouse of a beneficiary.
It is wise to use a lawyer or Notary Public to draft your Will to ensure that it covers all your wishes, and that it is legal and valid in BC. It must meet all the requirements of BC legisltation. Do-it-yourself kits can be 'penny-wise, pound-foolish'.
What to Include in a Will?
A Will should have a trusted Executor (and alternate Executor to be safe) to carry out your final wishes. Make sure these people are willing and able to act. Your Will describes how your estate should be handled and who it should go to (the beneficiaries). A beneficiary can receive part of your estate, or a specific item or sum of money, etc. If you have a minor child, you should appoint a Guardian in your Will. You'll set up a Trust for your minor children to take care of them finanically. A Will can include funeral and burial arrangements as you wish. You can also donate money to a charity.
