Statutory Declaration of Common-Law Union (IMM 5409) Requirements
Before you and your partner both sign and swear the IMM5409 declaration, we ensure you have both read and fully understood the IMM5409 form. You will then both swear that the statements in the document are true. The legal requirements for statutory declarations are as follows:
- You must both be physically present with the Commissioner of Oaths when signing.
- You must both indicate that you have read and understood the document.
- You both make the declaration conscientiously believing it to be true and knowing that it is of the same legal force and effect as if made under oath.
- The Commissioner of Oaths must check both your government issued photo IDs.
After all this, the two partners can sign the Statutory Declaration of Common-Law, and we apply our stamp and notarial seal to your document.
